Code Compliance
Mission
"To protect property values, natural resources, ensure safe conditions, and enhance quality of life by enforcing City of Niceville codes and ordinances"
About Code Enforcement
The Code Compliance Department enforces ordinances for the incorporated areas of the City of Niceville. This includes regulations for land development and land use, as well as codes governing issues like junk, debris, and building without permits. The department's goal is to educate the public about these codes and ordinances and to achieve voluntary compliance on all issues in a professional and courteous manner. They focus on providing positive customer service to all citizens and bringing existing properties into compliance with the applicable codes and ordinances.
Code Compliance Officers and the Magistrate are administrative entities for the City of Niceville. They have the authority to impose administrative fines and other non-criminal penalties to ensure fair, effective, and cost-effective enforcement of codes and ordinances.
Florida Statute 162 authorizes Code Officers to initiate compliance proceedings through:
1. Notice of Violation to the property owner giving him or her a reasonable time to correct the violation.
2. Notice of Hearing before a magistrate when compliance cannot be gained voluntarily in a reasonable time period.
3. Stop Work Order when a major violation is committed such as land clearing without permits, wetland violations, and non-permitted building activity. Florida Statute requires due process and timely notification of hearings.
